La necesidad de adicionar al artículo 134 BIS del Código Civil del Estado de Michoacán, en cuanto a la aclaración de las actas de nacimiento

Abstract

This work is basically focused on adding article 134 Bis of the Civil Code of the State of Michoacán regarding the Clarification of Birth Certificates, so that there is a new way to clarify administratively, economically and more quickly all birth certificates of people registered in any Civil Registry Court of the State of Michoacán de Ocampo. Likewise, this work points out the importance of carrying out the Administrative Clarification of Birth Certificate in said Courts since countless birth certificates have typing or spelling errors that in many cases were committed accidentally or involuntarily, which causes the name and / or surname (s) of the person to whom the certificate in question refers to to vary and that in many cases the affected person lacks the financial resources to carry out a Trial of Rectification and Modification of Birth Certificate before the Court of First Instance in Civil Matters of the corresponding Judicial District. which in addition to being time-consuming is expensive and processing said Administrative Clarification of Birth Certificate in the Civil Registry Courts of the State of Michoacán de Ocampo This procedure is administrative and not judicial, it would be easier, more agile and would have the same corresponding legal effects as a Trial for Rectification of a Certificate processed in a Court of First Instance in Civil Matters and in turn the workload would be considerably reduced in all the Jurisdictional Bodies (Courts of First Instance in Civil Matters) of all the Judicial Districts of the State of Michoacán that currently hear Trials for Rectification and Modification of Birth Certificates, in addition to, as already stated, the economic expense incurred by the affected person.

El presente trabajo, está enfocado básicamente en que se adicione el artículo 134 Bis del Código Civil del Estado de Michoacán en cuanto a la Aclaración de las Actas de Nacimiento, para que con ello exista una nueva forma de aclarar administrativa, económicamente y con mayor rapidez todas las actas de nacimiento de las personas registradas en el cualquier Juzgado del Registro Civil del Estado de Michoacán de Ocampo así mismo, en dicho trabajo se señala la importancia de realizar la Aclaración Administrativa de Acta de Nacimiento en dichos Juzgados ya que un sinfín de actas de nacimiento gozan de errores mecanográficos u ortográficos que en muchos casos se cometieron de forma accidental o involuntaria lo que hace variar el nombre y/o apellido(s) de la persona a que se refiere el acta en cuestión y que en muchas ocasiones la persona afectada carece de recursos económicos para poder llevar a cabo un Juicio de Rectificación y Modificación de Acta de Nacimiento ante el Juzgado de Primera Instancia en Materia Civil del Distrito Judicial correspondiente el cual además de tardado es oneroso y tramitando dicha Aclaración Administrativa de Acta de Nacimiento en los Juzgados del Registro Civil del Estado de Michoacán de Ocampo dicho trámite es administrativo y no judicial sería más fácil, más ágil y tendría los mismos efectos legales correspondientes que un Juicio de Rectificación de Acta tramitado en un Juzgado de Primera Instancia en Materia Civil y a su vez se reduciría de manera considerable la carga de trabajo en todos los Órganos Jurisdiccionales (Juzgados de Primera Instancia en Materia Civil) de todos los Distritos Judiciales del Estado de Michoacán que actualmente conocen sobre Juicios de Rectificación y Modificación de Actas de Nacimiento además como ya se dijo del gasto económico que se origina a la persona afectada.
