Abstract

This Documentary Catalog describes important documents contained in the Books of Hijuelas numbers 4 and 5 of the District of Zitácuaro corresponding to the years from 1870 to 1906. These documents are faithful testimony about the land distribution process of the indigenous communities of the state. of Michoacán, specific to the aforementioned District. As is already known, this distribution of land began with the Law of January 18, 1827, which stated that the distribution would be made exclusively among the descendants of the primitive families. Its regulations of February 15, 1828, indicated the rules and procedures to verify said distribution. To do this, each community had to elect a distribution commission made up of five people, whether from the same community or from outside it. This Commission would be in charge of creating an exact list of the families that would be entitled to the distribution, as well as a list of the lands suitable for this purpose. Furthermore, it was stipulated that the lands obtained from the distribution could not be sold, mortgaged, transferred or pawned during the four years following their possession.

En el presente Catálogo Documental se describen importantes documentos contenidos en los Libros de Hijuelas números 4 y 5 del Distrito de Zitácuaro correspondiente a los años de 1870 a 1906, dichos documentos son fieles testimonio acerca del proceso de reparto de tierras de las comunidades indígenas del estado de Michoacán, específico del Distrito mencionado. Como ya es sabido, dicho reparto de tierras se inició con la Ley del 18 de enero de 1827, la cual señalaba que el reparto se haría exclusivamente entre los descendientes de las primitivas familias. Su reglamento del 15 de febrero de 1828, señalaba las normas y procedimientos para verificar dicho reparto. Para ello cada comunidad debía de elegir una Comisión repartidora compuesta por cinco personas ya sean de la misma comunidad o ajena a ella. Esta Comisión se encargaría de conformar un padrón exacto de las familias que tendrían derecho al reparto, así como una lista de las tierras aptas para tal fin. Además, se dispuso que las tierras obtenidas del reparto no podían venderse, hipotecar, enajenar o empeñar durante los cuatro años siguientes de su posesión.
