Abstract

In the process of state-building understood as a notion of modernity, as an entity charged with safeguarding the individual through a balance in the control of both its powers and the actions of society, law played a determining role, since Became the means to achieve secularization and consequently the end of the predominance of theology. This process reached great fruits in the last third of the eighteenth century, when new codifications appeared and with them, the individual was enthroned as a rationalized subject, responsible for giving a systematic and coherent order to the law and its environment. This series of changes, as it points from the perspective of the history of the Gross law, gave rise to the emergence of political subjects that were consolidated through the effectiveness of power, but above all thanks to the psychology of power, as authentic states, until To those creatures of the late eighteenth century who before the eyes of the jurist became the creative state and producer of the legal, a state legislator for being aware of the political relevance of the legal and therefore controlling and monopolizing it. This phenomenon is related to the emergence of the modern judiciary and the establishment of new legal techniques linked to the professionalization of both jurisprudence and bureaucracy.

En el proceso de construcción del Estado entendido como una noción de la modernidad, como un ente encargado de salvaguardar al individuo mediante un equilibrio en el control tanto de sus poderes como de las acciones de la sociedad, el derecho jugó un papel determinante, ya que se convirtió en el medio para lograr la secularización y por consecuencia el fin del predominio de la teología. Este proceso alcanzó grandes frutos en el último tercio del siglo XVIII, período en que aparecieron nuevas codificaciones y con ellas, se entronizó al individuo como un sujeto racionalizado, encargado de darle un orden sistematizado y coherente al derecho y a su entorno. Esta serie de cambios -como señala desde la perspectiva de la historia del derecho Grossi-, dieron origen al surgimiento de sujetos políticos que se consolidaron mediante la efectividad del poder, pero sobre todo gracias a la psicología de poder, como auténticos Estados, hasta llegar a aquellas criaturas de finales del siglo XVIII que ante los ojos del jurista se convirtieron en el Estado creador y productor de lo jurídico, un Estado legislador por ser consciente de la relevancia política de lo jurídico y por consiguiente controlador y monopolizador del mismo. Este fenómeno se encuentra relacionado con el surgimiento de la judicatura moderna y la instauración de técnicas jurídicas nuevas vinculadas con la profesionalización tanto de la jurisprudencia como de la burocracia.
