Mujeres que hacen justicia por propia mano: apuntes psicoanalíticos sobre criminalidad y transgresión

Abstract

About women who have had experiences of abuse, hurt, rape, violence may resort to taking justice into their own hands. The damage leaves an indelible mark on the psyche of women, mark no being processed symbolically, seeking another exit. This work intends to analyze the discomfort that leaves the offense in women, the lack of justice and damage which are not processed by the symbolic register, discomfort pushing passage to the act. This work uses the interpretive discourse analysis of the case by a newspaper article entitled as the girl did justice into their own hands. This case is approached from psychoanalytic theory straddles the gender perspective, which allows us to reflect on the historical and cultural place that women occupy about justice, site relegated and undervalued. Just look at the remarks of the father of psychoanalysis about women and justice, to realize that they confer on them a place fair bit and unappreciated. Now, while men taking the justice into their own hands enjoy a position of heroism and their actions are justified under the ideology in the name of justice, women are condemned and punished for the same acts. Sobre las mujeres que a partir de haber vivido una o varias experiencias de ofensas, daños, abusos, violencias e inequidades recurren a la justicia por propia mano. Dichos daños han dejado una marca imborrable en el psiquismo de las mujeres, marca que al no ser tramitada simbólicamente busca otra salida. Este trabajo tiene la intención de analizar el malestar que deja en las mujeres la ofensa, la falta de justicia y el daño, los cuales regularmente no son atravesados por lo simbólico y en consecuencia el malestar intenta ser aliviado mediante el pasaje al acto en un crimen. Para ello se recurre al análisis interpretativo del discurso del caso titulado por una nota periodística como La niña que se hizo justicia por propia mano. El abordaje de este caso se realiza desde la teoría psicoanalítica atravesada por la perspectiva de género, nos permite reflexionar acerca del lugar que histórica y culturalmente han ocupado las mujeres con respecto a la justicia, lugar relegado y poco valorado. Basta con mirar las puntualizaciones del padre del psicoanálisis acerca de las mujeres y la justicia, para darnos cuenta que Freud les confiere a ellas un lugar poco justo y poco apreciado. Ahora bien, mientras que los hombres que hacen justicia por propia mano gozan de una posición de heroicidad y por sus actos se justifican bajo la ideología de en nombre de la justicia, a las mujeres se les condena y castiga por los mismos sucesos. Al distinguir la transgresión del crimen se puede dar cuenta que, aquellas mujeres que no se someten al orden patriarcal y que más bien logran transgredirlo igualmente han sido castigadas y condenadas, tratadas como delincuentes o criminales.
