Adolescencias y derechos humanos en contextos de migración. Retos ante la nueva Ley General de Derechos de Niños, Niñas y Adolescentes

Abstract

Since 2014, in Mexico, it was published in the official gazette of the Mexican federation the General Law of childen and adolescents rights (Ley general de derechos de niñas, niños y adolescentes, LGDNNA). It recognizes childre and adolescents with the ability to defend and demand their rights, for example, a child has the right to health, However, under any medical treatment it is important to listen and explain about the procedures to be performed. This same law also recognizes the family, the community and the State as responsible for guaranteeing their rights progressively and comprehensively. However, even with the recent modifications to the LGDNNA and governmental and non-governmental organizations that should positively influence the creation of spaces for full exercise of rights of children and adolescents throughout the country, it is important to investigate, how do adolescents who live in a context of migratory tradition recognize their rights? Thus, the aim of this document is to generate an exercise of questioning in adolescents from contexts of high migrant tradition, not to maintain a position of "life is like that, because there is noother way," but to encourage young people to move towards a self-critical position on the way in which those who live and perceive themselves, allowing themselves to generate future alternatives to their way of life in order to live as headlines of rights that recognize their guarantees and seek spaces to exercise and demand their rights.

Desde el año 2014, en México entró en vigor La Ley General de Niños, Niñas y Adolescentes (LGDNNA), ésta reconoce a menores de edad como titulares de derechos, con capacidad de defender y exigir sus derechos, por ejemplo, un NNA tiene derecho a la salud, sin embargo bajo cualquier tratamiento médico es importante escucharle y explicarle sobre los procedimientos a realizar. Esta misma ley reconoce también a la familia, a la comunidad y al Estado como los responsables de garantizar sus derechos de manera progresiva e integral. Es decir que no parte de una mirada reactiva que asume que los niños y niñas son un grupo vulnerable, los asume como capaces de tomar decisiones en torno a los procesos que les involucran. Aún cuando existe un gran avance en el número de investigaciones y análisis sobre migración infantil, hace falta generar mayores conocimientos que visibilicen y den idea del impacto que tiene este proceso en los menores de edad, sobre todo en los adolescentes, ya que la migración es un factor estresante que se asocia con múltiples problemáticas de salud, económicas, de género, políticas, sociales y familiares, entre otras categorías que implican el sano ejercicio y garantía de sus derechos. Así, este trabajo ha tenido como objetivo, generar un ejercicio de cuestionamiento en las y los adolescentes de contextos de alta tradición migrante, para no mantener una postura de "la vida es así, porque no hay de otra", para promover una postura autocrítica sobre la manera en la que se viven y se perciben los NNA, permitiéndose así generar alternativas futuras a su forma de vida para que puedan vivirse como titulares de derechos que reconocen sus garantías y buscan espacios para ejercer y exigir sus derechos.
