In this research work one will make a journey through the concept of crime and criminal constructed by Jacques Lacan in his 1950 conference: A Theoretical Introduction to the Functions of Psychoanalysis in Criminology. The main goal is, from this referential framework, to contribute to the discussion and illuminate the problem of subjective responsibility in the legal field, which French legislation tried to solve with the implementation of Article 64º of the Penal Code that legitimized the power of the psychiatrist, the criminologist and the psychologist to determine what is a crime and who is a criminal. Lacan strongly criticizes the ideological and philosophical foundations of this Article, and with it all the contemporary criminal justice, affirming that the psychoanalytic experience opens a gap to think of a responsible subject, even if he has broken the law influenced by madness or by any other subjective force that the will cannot control.
En la presente investigación se realizará un recorrido por el concepto de crimen y criminal construido por Jacques Lacan en su conferencia de 1950: Introducción teórica a las funciones del psicoanálisis en criminología. El objetivo es, desde ese marco referencial, poder contribuir a la discusión e iluminar el problema de la responsabilidad subjetiva dentro del campo jurídico, el cual en la legislación francesa se trató de resolver con la implementación del artículo 64º del Código Penal que legitimaba el poder del psiquiatra, del criminólogo y del psicólogo para determinar qué es un crimen y quién es un criminal. Lacan critica fuertemente los fundamentos ideológicos y filosóficos de dicho artículo, y con él a toda la política criminal contemporánea, afirmando que la experiencia psicoanalítica abre un espacio para poder pensar a un sujeto responsable por más que éste haya roto la ley influenciado por la locura o por cualquier otra fuerza subjetiva que la voluntad no pueda controlar.
