A constitutional principle states that everyone has the right to prompt and expeditious administration of justice; however, the current justice system is collapsing as a result of the large number of legal matters that come before it. This is where the need arises to develop avenues of access to justice that are effective in conflict resolution and efficient, while allowing all people to approach justice, under a legitimate framework and with respect for human rights. Alternative and restorative justice are constituted by alternative dispute resolution mechanisms (MASC s), such as mediation, conciliation, negotiation, arbitration and restorative practices. These mechanisms are conflict resolution procedures that, through a methodology applied by a neutral third party called a facilitator, enable the parties to manage and resolve their own conflict, in an atmosphere of dialogue and peace-building; Thus, they are projected as a way of access to justice to help depressurize the workload of the courts, allow justice to be more accessible and affordable and citizenship justice. In this regard, professional services of alternative mechanisms may be offered by trained and certified private facilitators, together with the public, with the aim of guaranteeing access to prompt and expeditious justice in the society of Morelia, Michoacán. In addition, in family matters, the MASC’s are spaces where not only are conflicts resolved that transcend legally, also enable private mediators to devote sufficient time to validating and safeguarding the kinship and emotional relationships that are violated in conflicts of this nature; thereby contributing, to transform conflicts and to build scenarios of social peace.
Un principio constitucional reza que toda persona tiene derecho a que se le administre justicia de manera pronta y expedita; sin embargo, el sistema de justicia actual se ve colapsado por la gran cantidad de asuntos jurídicos que llegan a sus instancias. Es aquí donde surge la necesidad de plantear vías de acceso a la justicia que sean eficaces en la resolución de los conflictos y eficientes, en tanto que, permitan que todas las personas puedan acercarse a la justicia, bajo un marco legítimo y de respeto a los derechos humanos. La justicia alternativa y la restaurativa se constituyen por mecanismos alternativos de solución de conflictos (MASC´s), tales como la mediación, la conciliación, la negociación, el arbitraje y las prácticas restaurativas. Estos mecanismos son procedimientos de solución de conflictos que, mediante una metodología aplicada por un tercero neutral llamado facilitador, permiten a las partes gestionar y resolver su propio conflicto, en un ambiente de diálogo y construcción de paz; por lo que se proyectan como una vía de acceso a la justicia para auxiliar a despresurizar la carga de trabajo de los juzgados, permitir que la justicia sea más accesible y asequible y ciudadanizar la justicia. En este sentido, se pueden ofertar servicios profesionales de mecanismos alternativos por facilitadores privados capacitados y certificados, conjuntamente con los públicos, con el objetivo de garantizar vías de acceso a la justicia pronta y expedita en la sociedad de Morelia, Michoacán. Además, en materia familiar, los MASC´s son espacios donde no sólo se resuelven los conflictos que trascienden jurídicamente, también, posibilitan que los mediadores privados dediquen el tiempo suficiente para validar y salvaguardar las relaciones de parentesco y emocionales que se vulneran en los conflictos de esta naturaleza; contribuyendo con ello, a transformar los conflictos y erigir escenarios de paz social.
