The present thesis to obtain the degree of Master in Law refers to the treatment given to the Inefficiency of Personería in the Code of Civil Procedures of the State of Michoacán de Ocampo and especially to the cases in which an incident of Lack of personería by the existence of some deficiency or omission in the power granted by the one who holds the right of action or of exception, which is extremely slow and the counterpart can not be smoothed to continue with the procedure in the main thing. In the case of ordinary civil trial, where there is some nonconformity with the incidental sentence, it is appealed in both effects, delaying the delivery of justice for what it sees in the background of the legal dispute. Congruent with the above, it will be analyzed with respect to the mandate contract that as it is regulated in the present one sees the need to make it simpler without covering with so many formalities, as well as that it can be extended until the execution of the sentence. With the purpose of not affecting the rights acquired by the parties and third parties, constituting a lower monetary expense for the same and especially for the State, being the obligation of the judge to review during the procedure that the subjects acting in the same have duly accredited His personality and personería and if it is not thus giving by not admitting its intervention. It is for this reason that the present research work is dogmatic with a positivist approach, since when I realize that in the State of Michoacán de Ocampo as regards the questions of civil procedure, there are actions by the State that delay the procedure For the parties and the good administration of justice in matter of personería, brings with consequence an economic and social cost.
La presente tesis para obtener el grado de Maestra en Derecho se refiere al tratamiento que se le da a la Ineficacia de la Personería en el Código de Procedimientos Civiles del Estado de Michoacán de Ocampo y en especial a los casos en que se haya promovido incidente de falta de personería por la existencia de alguna deficiencia u omisión en el poder otorgado por quien ostenta el derecho de acción o de excepción, el cual es sumamente lento y la contraparte no puede allanarse para continuar con el procedimiento en lo principal. Tratándose del juicio ordinario civil, en donde sí existe alguna inconformidad con la sentencia incidental ésta es apelable en ambos efectos, retardando la impartición de justicia por lo que ve al fondo del conflicto jurídico. Congruente con lo anterior, se analizará con respecto al contrato de mandato que como se encuentra reglamentado en el presente se ve la necesidad de hacerlo más sencillo sin cubrir con tantas formalidades, así como también que éste pueda ampliarse hasta la ejecución de la sentencia. Con la finalidad de no afectar los derechos adquiridos por las partes y terceros, constituyendo un gasto monetario menor para las mismas y sobre todo para el Estado, siendo obligación del juez el revisar durante el procedimiento que los sujetos que actúan en el mismo tengan debidamente acreditada su personalidad y personería y si no es así dando por no admitiendo su intervención. Es por ello que el presente trabajo de investigación es dogmático con un enfoque positivista, ya que al darme cuenta que en el Estado de Michoacán de Ocampo por lo que ve a las cuestiones del procedimiento civil, existen actuaciones por parte del Estado que retardan el procedimiento para las partes y la buena administración de justicia en materia de personería, trae como consecuencia un costo económico y social.
