Elementos histórico-filosóficos del derecho a la información en México

Abstract

The main objective that I set out to carry out was: To describe and identify, in the philosophical thought of several Mexican authors, elements of the right to information, to make some contributions for their study, theoretical development and incorporation into the normative framework of Mexico. The starting hypothesis under which we were governed was the following: Throughout the history of Mexican thought it is possible to find some antecedents of the current right to information that will allow us to know it as a human right; As well as highlight their importance for the transition to democratic societies, in addition to promoting their academic, doctrinal, legislative and jurisprudential development. The methodology used consisted in carrying out an exploratory study, in order to carry out a thorough search of the existing bibliography on the philosophical thought in our country, and to give priority to the literature that has been produced in Mexico on the subject that occupies us . We also reviewed various constitutional and secondary legislation that would be useful to us; As well as the criteria issued by the Court in this regard.

El objetivo principal que me fijé para llevarla a cabo fue: Describir e identificar, en el pensamiento filosófico de varios autores mexicanos, elementos del derecho a la información, para realizar algunas aportaciones para su estudio, desarrollo teórico e incorporación al marco normativo de México. La hipótesis de partida bajo la cual nos regimos fue la siguiente: A lo largo de la historia del pensamiento mexicano es posible encontrar algunos antecedentes del actual derecho a la información que nos permitirán conocerlo como derecho humano; así como destacarán su importancia para el tránsito hacia sociedades democráticas, además de favorecer su desarrollo académico, doctrinal, legislativo y jurisprudencial. La metodología utilizada consistió en llevar a cabo un estudio exploratorio, con el objeto de realizar una búsqueda minuciosa de la bibliografía existente sobre el pensamiento filosófico en nuestro país, y dar prioridad a la literatura que se ha producido en México acerca del tema que nos ocupa. Asimismo se revisaron diversas legislaciones de carácter constitucional y secundario que nos serían de utilidad; así como los criterios emitidos por la Corte al respecto.
