Quantum de la pena a los partícipes del delito en el Estado de Michoacán

Abstract

El motivo de la realización de la presente investigación, parte de que en el Código Penal del Estado de Michoacán, las penas que en la actualidad le son impuestas a las personas que participan en un delito, son las mismas que se le fijan al autor de un injusto penal, por lo que al momento de individualizar la sanción, se hace siguiendo los parámetros establecidos para cada tipo penal, empero, la pena nunca podría ser inferior al mínimo contenido en el propio tipo penal, so pena de violar el principio de estricta aplicación de la ley; lo cual redunda en perjuicio del partícipe en el delito, ya que su contribución al hecho es menor al autor del delito, pues el partícipe tiene el carácter de figura accesoria en la comisión del hecho delictivo, que independientemente de su aportación al injusto penal, no está en sus manos detener el curso del mismo, el cual se realiza no obstante la aportación del partícipe. Cabe destacar que este tema se ha elegido debido a la vinculación laboral en la que se aborda ese tópico, al trabajar durante un tiempo en un juzgado de primera instancia en materia penal, y por tanto en constante estudio con el Código Penal del Estado, se advierte que al dictar sentencia definitiva a un partícipe en el delito, la mencionada codificación establece la misma pena a los autores y partícipes, lo que redunda en perjuicio del partícipe, ya que su conducta es de carácter secundario a la del autor.
