De los mitos y pasiones. Una aproximación del derecho cultural a la política

Abstract

For starters, I ask the reader to bear with this introduction, while it is open to my writing as I am aware that this is a law graduate thesis, not a collection of anecdotes. After reviewing this work, my thesis supervisor asked me the reason for my approach to culture (bunka with kanji??) Japanese which is inserted in some parts of the thesis, at that time I could not answer as wished, now try to do so shortly. Since childhood, I have always felt a deep curiosity about other cultures, to my view, were part of faraway and extraordinary stories. Approaching one of these cultures, it was not through books of history, geography, art and travel, it was a couple of years ago, when I first read the Japanese writer Haruki Murakami. Before my eyes, a variety of dream and fantasy world was discovered, but at the same time believable, so close that I could not feel anything but fear that painfully familiar and nostalgic feeling. At my feet came the memory of having gone through the Ueno station, Ginza and Shinjuku, my mouth seemed to remember the taste of miso soup and mugicha, but so far, in this life, had not ever heard his name. One day, I got an email from a travel agency, I had subscribed to the newsletter months ago, waiting for something, not knowing why.

Para comenzar, pido al lector que tenga paciencia de esta introducción, al tiempo que, sea abierto a mi forma de escribir pues estoy consciente que se trata de una tesis de posgrado de derecho, y no un anecdotario. Luego de revisar este trabajo, mi directora de tesis me preguntó la razón de mi abordaje de la cultura (bunka con los kanjis??) japonesa que está insertada en algunas partes de la tesis, en ese momento no pude responder como hubiese deseado, ahora trataré de hacerlo lacónicamente. Desde niño, siempre he sentido una profunda curiosidad por otras culturas que, a mi manera de ver, eran parte de cuentos lejanos y extraordinarios. El acercamiento a una de esas culturas, no fue a través de libros de historia, de geografía, de arte o de viajes, fue hace un par de años, cuando leí por vez primera al escritor japonés Haruki Murakami. Frente a mis ojos, se descubrió una variedad de mundo onírico y fantástico, pero al mismo tiempo verosímil, tan cercano que no pude sentir otra cosa que temor ante esa sensación dolorosamente familiar y nostálgica. A mis pies llegaba el recuerdo de haber transitado por las estaciones de Ueno, Ginza y de Shinjuku, mi boca parecía recordar el sabor de la sopa miso y la mugicha, aunque hasta ese momento, en esta vida, no hubiera escuchado su nombre jamás. Un día, me llegó un correo electrónico de una agencia de viajes, me había suscrito al boletín de noticias meses atrás, esperando algo, sin saber qué.
