La legitimación del poder estatal a través de la soberanía ¿legitimidad en crisis?

Abstract

This paper offers a new approach to sovereignty, analyzing not only from the perspective of the state but also of the individual and the effect it causes, so, this research aims to move away from "traditional" studies on the subject, proposing a new way of conceiving, namely, as a means to legitimize power, this from the theoretical perspective of Pierre Bourdieu. Sovereignty does not mean power and territory, sovereignty is not a force field that defines the boundaries of countries, the main function is to legitimize the sovereignty of state power. From the study will now be made clear that sovereignty has two aspects or faces, one national and one international, behaving differently in each. Nationally sovereignty enables the recognition and legitimation of power; internationally, sovereignty appears as a common quality among states contributing to the acceptance of international rules of cooperation and peaceful coexistence. Sovereignty view from Pierre Bourdieu's theory, shown as the means to legitimize state power, and the rules and institutions that he imposes as natural. Therefore, sovereignty is not, as some authors assert absolute power, decision making, power, plain and simple, or even ability to legislate, sovereignty view through the glass of this century is presented as the means and not the end ie, as a tool to legitimize power.

El presente trabajo pretende ofrecer un nuevo enfoque sobre la soberanía, analizándola no sólo desde la perspectiva del Estado sino también del individuo y el efecto que en él causa, así, ésta investigación pretende apartarse de los estudios “tradicionales” sobre el tema, proponiendo una nueva forma de concebirla, esto es, como medio para legitimar el poder, esto desde la perspectiva teórica de Pierre Bordieu. Soberanía no significa poder y tampoco territorio, la soberanía no es un campo de fuerza que delimita las fronteras de los países, la función principal de la soberanía es legitimar el poder del Estado. Del estudio realizado a continuación se hará patente que la soberanía posee dos vertientes o caras, una nacional y otra internacional, comportándose de una manera distinta en cada una de ellas. En el ámbito nacional la soberanía posibilita la legitimación y el reconocimiento del poder; en el internacional, la soberanía se presenta como una cualidad común entre los Estados que contribuye a la aceptación de las reglas internacionales de cooperación y convivencia pacífica. La soberanía vista desde la teoría de Pierre Bordieu, se muestra como el medio para legitimar el poder del Estado, así como las reglas e instituciones que él impone como naturales. Por lo tanto, la soberanía no es, como afirman algunos autores poder absoluto, capacidad de decisión, poder simple y llano, o inclusive capacidad de legislar, la soberanía vista a través del cristal de este siglo se presenta como el medio y no el fin, es decir, como la herramienta para legitimar el poder.
