The issue of centralism and federalism, in the exercise of judicial review by the Supreme Court of Justice, goes a long study, development, analysis, criticism and controversy, and includes or involves real or fictional unravel the meaning of the current federalism. The work is divided into four themes, the first of which refers generally to constitutional control by the Judicial Power of the Federation, of which I make a brief historical sketch, from the date it was passed the first Constitution independent, to the latest constitutional amendments of the Constitution of the United Mexican States of 1917, concerning the Judicial Power of the Federation and the Supreme Court of Justice Mexico. In the brief historical sketch highlights that our country is always divided in two main political groups themselves who fight their political ideology but not always the most appropriate, also broadly seen in the development of this sub-theme that our federal judiciary is not had gained importance over the years by the performance in the delivery of justice, now even our laws in most of them are outdated and obsolete by the reality of life, should always have a solution the distributers justice, that is why their resolutions are often the interpretation of the law consistently, teleological, conversely, among others, without exceeding the general Constitution, one could say that to act as legislators.
El tema de Centralismo y federalismo, en el ejercicio del control constitucional por la Suprema Corte de Justicia de la Nación, da para mucho estudio, desarrollo, análisis, crítica y polémica, e incluye o implica desentrañar el significado real o ficticio del federalismo actual. El trabajo se divide en cuatro temas, el primero de ellos se refiere en términos generales al control constitucional por el Poder Judicial de la Federación, del cual realizo una brevísima semblanza histórica, a partir de la fecha en que fue promulgada la primera Constitución Política del México independiente, hasta las últimas reformas constitucionales de la Constitución Política de los Estados Unidos Mexicanos de 1917, referentes al Poder Judicial de la Federación y de la Suprema Corte de Justicia de la Nación. En la brevísima semblanza histórica resalta que nuestro país siempre está dividido principalmente en dos grupos políticos, mismos que pelean su ideología política aunque no siempre sea la más adecuada, también a grandes rasgos se ve en el desarrollo de este subtema que nuestro Poder Judicial federal no tenía la importancia que se fue ganando a través de los años por el desempeño en la impartición de justicia, pues ahora aunque nuestras leyes en gran parte de ellas son superadas u obsoletas por la realidad que se vive, siempre deben tener una solución los impartidores de justicia, es por eso que sus resoluciones son en muchos casos la interpretación de la ley de manera sistemática, teleológica, a contrario sensu, entre otras, sin sobrepasar la Constitución general, se podría decir que hasta actúan como legisladores.
