La tutela judicial efectiva como derecho humano

Abstract

The "Effective Judicial Custody" is from the terms of Article 17 of the Constitution. This is so because the right to an effective remedy, is not only understood as the right to jurisdiction, but as a broader right, because not only have the right to access the courts to raise our conflicts, but also we will provide a prompt and expeditious resolution; and besides, it is done to enforce compliance with this law. In this three-pronged approach is what is called Effective judicial protection. Therefore, when the judiciary responsible for applying and interpreting laws, its main function is to enforce that law and provide legal security of all people. On the understanding that legal certainty is the quality of law and public institutions to produce certainty and confidence in the city, what is right at all times, and what will be expected in the future.

La “Tutela Judicial Efectiva”, se infiere del contenido del artículo 17 Constitucional. Esto es así, porque el derecho a la tutela judicial efectiva, no solo es entendido como el derecho a la jurisdicción, sino como un derecho más amplio, ya que no sólo tenemos derecho a accesar a los tribunales a plantear nuestros conflictos, sino también a que se nos brinde una resolución pronta y expedita; y además, a que se haga efectivo el cumplimiento de ese derecho. A este triple enfoque es a lo que se le denomina Tutela Judicial Efectiva. Por lo tanto, al ser el Poder Judicial el encargado de aplicar e interpretar las leyes, tiene como función principal hacer efectivo ese derecho y a brindar seguridad jurídica de todas las personas. En la inteligencia, que seguridad jurídica es la cualidad de la ley y de las instituciones públicas de producir certeza y confianza en el ciudadano, sobre lo que es derecho en cada momento, y sobre lo que previsiblemente será en el futuro.
