On the generality of cultures, families serve as the primary socializing agent between humans. Admittedly, while it has gone through different cycles in the marriage, the nuclear family is interfering remains despite all the changes occurring in society. No doubt this has obeyed to the problem faced by many couples about infertility and sterility.
En la generalidad de las culturas, las familias sirven como el agente socializador primario entre los seres humanos. Hay que reconocer que a pesar de que ha pasado por diferentes ciclos en lo que se inmiscuye el matrimonio, la familia nuclear sigue vigente a pesar de todos los cambios que se dan en la sociedad. El papel que juega la familia y el matrimonio dentro del Derecho de familia, conlleva al tema principal tocante al sustento jurídico y social de “la reproducción humana no coital”, además siendo la maternidad base fundamental en toda familia, juega un papel preponderante en cualquier sociedad, y resulta fundamental regularla jurídicamente de acuerdo al avance científico, tecnológico y a la actual realidad social. La procreación artificial, fecundación in vitro o reproducción humana no coital, (fenómeno sin duda difícil de detener y de negar a estas alturas), adquirieron consistencia en la década de los 60´s, por equipos médicos ingleses y australianos. Es así, como inicia una nueva era de la reproducción humana diferente a la tradicional en la que como todo, surge buscando dar una solución a un problema social, pero que luego sus efectos no fueron previstos tanto por el legislador como el propio investigador, sin dejar a un lado la aceptación de la sociedad ya que muchas parejas se enfrentan a cuestiones de tipo social y jurídico, en la cual no les permite del todo tener una solución completa a su problema, por lo que no podemos quedarnos inmóviles y pasivos, sino que debemos buscar los mecanismos más adecuados para poder ingresar al fenómeno a todos los campos sin tener repercusiones tanto sociales como jurídicas. Sin duda esto ha obedecido al problema que enfrentan numerosas parejas respecto a la infertilidad y esterilidad.
