Han sido incontables las ocasiones en que la Cámara de Diputados al crear o modificar leyes fiscales, lo realiza sin una técnica jurídica adecuada, nítida, clara; lo cual ocasiona posteriormente, que el contribuyente afectado al sentirse agraviado, impugne en los tribunales los artículos y párrafos particulares que considera le afectan a su esfera jurídica, esto es así, quizá porque al legislador no lo mueven cuestiones jurídicas puras para legislar sino cuestiones políticas. Consideramos que existen diversos párrafos en varios artículos de la L.I.S.R. que tienen una redacción desafortunada, rebuscada, incongruente que conlleva un problema gramatical y que al momento de aplicarlos de manera textual y ser convertidos por parte del contribuyente en datos numéricos, puede tener consecuencias fiscales y jurídicas importantes. ¿Qué pasa cuando en una Ley fiscal algún artículo contiene un párrafo que obliga al contribuyente a hacer cálculos inciertos?, ¿qué hacer cuando ese párrafo, según el contribuyente, origina que determine ingresos acumulables mayores a los que determinaría si ese párrafo estuviera lo suficientemente claro?, ¿debe esperar a que la autoridad fiscal se pronuncie y aclare la situación?, ¿debe inconformarse ante los tribunales?, ¿debe hacer los cálculos como le son indicados, es decir, de manera textual, a pesar de los perjuicios con los que pudiera sentirse agraviado?, ¿debe interpretar y hacer esos cálculos basado en el “espíritu de lo que el legislador quiso decir” en el texto de ley?.
