Abstract

The evolution in the structure of the modern state was reflected in the way they organize their government, using the application of foreign models and structures. Such is the case of countries opting for government systems supported by the principle of Locke and Montesquieu; that they have prevailed for centuries in Western countries. As we know this system of government it makes a division of functions placing them into three branches: the executive, the legislature and the judiciary; but this classic theory of the division of powers today they have added some variety in your organization, spreading among other things the rigidity with which previously the functions of each power is structured, when confined to the exclusive exercise of its function basically a literal sense. Situation that currently do not favor the demands and needs of the contemporary state. A sample of these changes in the functions of the institutions of the Mexican State in which it has been even more noticeable evolution degree of flexibility to those functions that correspond to each of the branches of government, and even has added to the structure autonomous government agencies; This transformation is undoubtedly indubitable guideline towards simplification activities in the branches of government and constitutional control of acts of government, but mainly the pursuit of the general welfare that demands our nation.

La evolución en la estructura del Estado moderno se ha visto reflejada en su forma de organizar su gobierno, valiéndose de la aplicación de modelos y estructuras extranjeros. Tal es el caso de países que optan por sistemas de gobierno sustentados en el principio de Locke y Montesquieu; que han prevalecido por siglos en países de Occidente. Como sabemos este sistema de gobierno realiza una división de las funciones del Estado ubicándolas en tres poderes: el ejecutivo, el legislativo y el judicial; pero a esta teoría clásica de la división de poderes hoy en día se le han agregado algunas variantes en su organización, diseminándose entre otros aspectos la rigidez con la que anteriormente se estructuraban las funciones de cada poder, cuando se limitaban al ejercicio exclusivo de su función en un sentido básicamente literal. Situación que en la actualidad no favorecería a las demandas y necesidades del Estado contemporáneo. Una muestra de estas transformaciones en las funciones de las instituciones del Estado Mexicano en las que ha sido más notoria su evolución inclusive al grado de flexibilizar aquellas funciones que corresponden a cada uno de los Poderes de la Unión, e inclusive se ha sumado a la estructura gubernamental organismos autónomos; esta indubitable transformación representa sin duda la directriz hacia la simplificación de actividades en los poderes del Estado y al control constitucional de los actos de gobierno, pero principalmente la búsqueda del bienestar general que reclama nuestra Nación.
