El impacto de las resoluciones de la Corte Interamericana en el ordenamiento mexicano

Abstract

This research aims to elucidate the effects detached from the judgments of the Inter-American Court of Human Rights against the Mexican state, emphasizing the problems relating to the implementation of these judgments and obligations arising therefrom; equally and to have a wider margin of background knowledge and the Organization of American Court of Human Rights is investigated, as well as some of the resolutions that have been passed against the Mexican state. Thus we conclude, that have not been materially emphasized the resolutions issued by the Court, this being one of the aspects of commitment to the Mexican State in the international community; stressing so, the subsidiary responsibility of officials for the violation of human rights, so that the State has the obligation to carry out adjustments to their domestic law, in order assing responsibilities, whether civil, criminal or administrative corresponding officer, it implies a duty of States Parties to organize the governmental apparatus and, in general, all the structures through which the exercise of public power is manifested.

La presente investigación tiene como propósito dilucidar los efectos desprendidos de la sentencias emitidas por la Corte Interamericana de Derechos Humanos contra el Estado mexicano, enfatizando la problemática en relación con el cumplimiento de dichas sentencias y las obligaciones que de ellas se derivan; de igual forma y para tener un margen más amplio de conocimiento se investigan los antecedentes y la Organización de la Corte Interamericana de Derechos Humanos, así como algunas de las resoluciones que se han dictado contra el Estado mexicano. Así pues se concluye, que no se han enfatizado materialmente las resoluciones emitidas por la Corte Interamericana, siendo este uno de los aspectos del compromiso que tiene el Estado mexicano ante la comunidad internacional; subrayando así, la responsabilidad subsidiaria que tienen los funcionarios por la violación de los derechos humanos, por lo que el Estado tiene la obligación de llevar a cabo adecuaciones a su derecho interno, con el fin de atribuir responsabilidades, ya sea civil, penal o administrativa al funcionario correspondiente, pues implica un deber de los Estados parte, de organizar todo el aparato gubernamental y, en general, todas las estructuras a través de las cuales se manifiesta el ejercicio del poder público.
