Since the constitutional reform in Criminal Matters of 18 June 2008, extrajudicial detention was incorporated into our Constitution. Extrajudicial detention empowered the public prosecutor to detain arbitrarily to likely responsible for the commission of serious crime and organized crime. Illegally detentions in most of the time, under the mere suspicion without any warrant, arresting to investigate instead of investigating to arrest as it is constrained by the Constitution, in violation of the principles of due process of legal security, presumption of innocence and freedom included in the Constitution and international treaties to which the country belongs.
A partir de la reforma constitucional en materia penal de 18 de junio de 2008, en que se incorporó a nuestra Constitución la figura del arraigo, se dotó de mayores herramientas al Ministerio Público para detener de manera arbitraria a probables responsables de la comisión de delitos graves y delincuencia organizada. Detenciones realizadas de manera ilegal en la mayoría de las veces, bajo la simple sospecha y sin una orden de aprehensión, deteniendo para investigar en vez de investigar para detener como se está constreñido por la misma Constitución, violando así los principios de debido proceso, de seguridad jurídica, presunción de inocencia y libertad consagrados en la Constitución y en tratados internacionales de los que nuestro país forma parte.
