The treasury authority has issued strategies in order to implement actions aimed at eradicating aggressive tax evasion practices, Focusing on the traffic of tax receipts, placing in this scheme two subjects involved in the traffic of apocryphal tax receipts, on the one hand the EFOS Builders Companies of Simulated Operations, taxpayers that have their particular characteristics that we will analyze in the development of the present investigation, who have the intention of placing in the market a fiscal receipt that lacks economic substance, in order to sell it and in such a way obtain a mainly economic benefit, the buyer of the tax receipts is called EDOS Companies that Deduce Simulated Transactions, who intervene in the traffic of tax receipts by acquiring the tax receipt online looking for a deduction and making the corresponding accreditation of the operations covered in such receipts in order to erode the base of the federal taxes to which they are affected, the cycle of voucher traffic ends when the seller of the tax receipts returns the amounts delivered by the purchaser minus a previously agreed commission. Article 69-B of the Fiscal Code of the Federation provides a procedure by means of which the fiscal authority may presume the inexistence of the operations covered in the tax receipts when the assumptions established in said article are configured.
La autoridad hacendaria ha emitido estrategias con el fin de implementar acciones tendientes a erradicar las prácticas agresivas de evasión fiscal, focalizándolo en el tráfico de comprobantes fiscales, ubicando en dicho esquema a dos sujetos que intervienen en el tráfico de comprobantes fiscales apócrifos, por un lado los EFOS Empresas Facturadoras de Operaciones Simuladas, contribuyentes que tienen sus características particulares que analizaremos en el desarrollo de la presente investigación, quienes tienen la intención de situar en el mercado un comprobante fiscal que carece de sustancia económica, con el objeto de venderlo y de tal forma obtener un beneficio principalmente económico, el comprador de los comprobantes fiscales se denomina EDOS Empresas que Deducen Operaciones Simuladas, quienes intervienen en el tráfico de comprobantes fiscales adquiriendo el comprobante fiscal por internet buscando una deducción y realizando el acreditamiento correspondiente de las operaciones amparadas en dichos comprobantes para de tal forma erosionar la base de los impuestos federales a los que se encuentran afectos, el ciclo de trafico de comprobantes finaliza cuando el vendedor de los comprobantes fiscales devuelve las cantidades entregadas por el adquiriente menos una comisión previamente pactada. El artículo 69-B del Código Fiscal de la Federación brinda un procedimiento por medio del cual la autoridad fiscal podrá presumir la inexistencia de las operaciones amparadas en los comprobantes fiscales cuando se configuren los supuestos que establece el mencionado artículo.
