El derecho de acceso de los pacientes a su expediente clínico

Abstract

The Law of Information is a highly specialized Legal Science of Law, forming instruments, standards and studies to guarantee various rights and freedoms related to informational activity, its main object of study is information. One of these rights is the so-called Right of Access to Information, the same prerogative that gives rise to the following statement of thesis called "The Right of Access of Patients to their Clinical Record", through the Right to Information we can find a right key to the exercise of other rights such as the right to health, therefore the case study of the Mayo Clinic Health Care System is presented in front of the Mexican Institute of Social Security regarding the management of the clinical file and the access that users have of these health service administration societies.

El Derecho de la Información es una Ciencia Jurídica altamente especializada del Derecho, formando instrumentos, normas y estudio para garantizar diversos derechos y libertades relacionados con la actividad informativa, su principal objeto de estudio es la información. Uno de estos derechos es el llamado Derecho de Acceso a la Información, misma prerrogativa que da origen al siguiente planteamiento de tesis denominada: "El Derecho de Acceso de los Pacientes a su Expediente Clínico", a través del Derecho a la Información podemos encontrar un derecho llave para el ejercicio de otros derechos como el derecho a la salud, por lo anterior se presenta el estudio de caso del sistema Mayo Clinic HealtCare System frente al Instituto Mexicano del Seguro Social en cuanto al manejo del expediente clínico y el acceso que tienen los usuarios de estas sociedades administradoras de servicios de salud.
