El derecho fundamental a la salud. Perspectivas desde una dimensión analítica

Abstract

One of the main issues on the rise within contemporary legal theory and current legal dogmatics in Mexico, due to its complexity and importance, is the fundamental right to health, and the way in which it is guaranteed in our Constitution, by What, in the present research, a detailed study of the elements that make up the conceptual legal structure of said prerogative has been carried out, through the analytical dimension of legal dogmatics as a theoretical, purely formal and structural form, which allowed us have a general overview of the scope and legal influences of the fundamental right to health recognized in our fundamental law and generate a legal criterion from which there is a clear need to update the constitutional text related to the health issue.

Uno de los principales temas en auge dentro de la teoría jurídica contemporánea y la dogmática jurídica actual en México, debido a su complejidad e importancia, es el derecho fundamental a la salud, y la forma en que éste se encuentra garantizado en nuestra Constitución, por lo que, en la presente investigación se ha realizado un estudio pormenorizado de los elementos que integran la estructura jurídico conceptual de dicha prerrogativa, a través de la dimensión analítica de la dogmática jurídica como una forma teórica, puramente formal y estructural, lo que nos permitió tener un panorama general de los alcances e influencias jurídicas del derecho fundamental a la salud reconocido en nuestra ley fundamental y generar un criterio jurídico del que se advierte una clara necesidad de actualizar el texto constitucional relacionado al tema de salud.
