Los bienes y derechos reales

Abstract

The content of this research project whose immediate objective is to obtain the degree of Master of Law, deals with two major issues: The Goods and real rights which are the subject of study program Civil Law II, within the curriculum current School of Law and Social Sciences; and also includes the new curriculum, as are issues that should not be missed in any program that matter, so it is mandatory study both in doctrine and in law, in order that the student who is in his second year of law degree have sufficient knowledge about the heritage in which we find the goods as part of the active element and the real rights that currently exist. The long term goal of this research is to provide a tool for students of Civil Law II that facilitates understanding of the diverse and extensive items on the program for that matter. Besides these issues correlate with both federal and state legal regulations that may apply. Hence the initial part of the research includes studies of the economic rights to immediately address the goods, and ranking. Subsequently, the study of each of the real rights, starting with the property, its forms and limitations ago; co-ownership as a special form of property. In Chapter VI, we study the actual beneficial interest, persons involved in it, the rights and obligations of persons bound by this legal relationship that emerges from the constitution of that property right. In Chapter VII we deal with the study of the real right of use and habitation; as well as the differences between real rights. Chapter VIII real easement is addressed; classification; persons involved in this law and the rights and obligations each has in that property right.

El contenido del presente trabajo de investigación cuyo objetivo inmediato es obtener el grado de Maestría en Derecho, versa sobre dos grandes temas: Los Bienes y Derechos Reales que son objeto de estudio del programa de la materia de Derecho Civil II, dentro del plan de estudios vigente de la Facultad de Derecho y Ciencias Sociales; así como también los comprende el nuevo plan de estudios, puesto que son temáticas que no deben pasar desapercibidas en ningún programa de esa materia, por lo que se hace obligatorio su estudio tanto en la doctrina como en la legislación, con la finalidad de que el alumno que cursa el segundo año de la carrera de derecho cuente con los conocimientos suficientes acerca del patrimonio en el cual encontramos los bienes como parte del elemento activo y los derechos reales que actualmente existen. El objetivo mediato del presente trabajo de investigación es dotar de una herramienta a los estudiantes de la materia de Derecho Civil II que les facilite la comprensión de los diversos y extensos temas contenidos en el programa de dicha materia. Además de correlacionar esos temas con la normatividad jurídica tanto federal como estatal que resulten aplicables. De ahí que la parte inicial de la investigación comprenda el estudio del Derecho Patrimonial para inmediatamente después abordar los bienes, y su clasificación. Posteriormente, se hace el estudio de cada uno de los derechos reales, empezando por la propiedad, sus modalidades y limitaciones; la copropiedad como una forma especial de la propiedad. En el capítulo VI, se estudia al derecho real de usufructo, los sujetos que intervienen en él, los derechos y obligaciones de los sujetos vinculados por esa relación jurídica que se desprende de la constitución de ese derecho real. En el capítulo VII nos ocupamos del estudio del derecho real de uso y de habitación; así como las diferencias que existen entre ambos derechos reales.
