El trasplante fetal y su regulación en México

Abstract

In the history of humanity the violation of fundamental rights has been recurring and could mention a number of examples, but called attention a form that could be cited as a recent, relative to biomedical research where the main actor is not born, the imminent technological advancement entails adjustments to both legal and social structure, and therefore a new perspective on what is morally and ethically right, from it the necessary adaptation of the legal system that protects the rights discusses the life as a fundamental right par excellence necessary condition being the recognition of the unborn human category.

En la historia de la humanidad la conculcación de derechos fundamentales ha sido recurrente y se podrían mencionar un sin número de ejemplos, sin embargo llama especial atención una forma que podría citarse como reciente, la relativa a las investigaciones biomédicas en donde el principal actor son no nacidos, el inminente adelanto tecnológico conlleva adecuaciones a la estructura tanto jurídica como social, y por consiguiente una nueva perspectiva de lo que se considera moralmente ético y correcto, a partir de ello se analiza la necesaria adecuación del sistema jurídico que proteja el derecho a la vida como el derecho fundamental por excelencia siendo condición necesaria el reconocimiento de la categoría humana al no nacido.
