La justicia en la función jurisdiccional

Abstract

Voices calling for justice before a crime, do not always find an answer, since the Mexican legal system belongs to the Romano-Germanic family and is; By nature can only do what the law allows. In addition to the above that also by order of jurisprudence, the judges should only do what the law in force prescribes. Hence, when they succeed in intersecting the law with justice, an optimal state is reached, a situation that does not occur in most of the judicial decisions, which is why the purpose of this paper is to achieve constitutional reform in order to To incorporate the value justice, with the purpose that the judges solve the issues that are raised, having as the first sieve in resolving equity.

Las voces que claman justicia ante un crimen, no siempre encuentran respuesta, ya que el sistema jurídico mexicano pertenece a la familia Romano-Germánica y está; por naturaleza solo puede hacer lo que la ley le permite. Aunado lo anterior que también por mandamiento de la jurisprudencia los juzgadores solo deben hace lo que el derecho vigente les prescribe. De ahí que cuando logran hacer intersección el derecho con la justicia se llega a un estado óptimo, situación que no sucede en la mayoría de las resoluciones judiciales, razón por la que el presente trabajo tiene como propósito, lograr una reforma constitucional a efecto de que se incorpore a la carta magna el valor justicia, con el propósito de que los juzgadores resuelvan los asuntos que les son planteados, teniendo como primer tamiz al resolver la equidad.
