The present project includes a constitutional-administrative analysis, on the jurisprudence and theory of the arguments that give rise to the figure of Patrimonial Responsibility of the Legislator, as a consequence of the declaration of unconstitutionality of a law. This study is based on a comparison in the Spanish legal system. The importance and reasons for which bases of that system are taken, are given first because the generic figure of State Patrimonial Responsibility in our Mexican legal system, represents the doctrinal contributions of the administrativeist Álvaro Castro Estrada, who in turn represents the ideas Doctrine of the Spanish administrativeist and constitutionalist Eduardo Garcia de Enterría, ideas that represent without any doubt are the inspiration of the contributions that in that country have been made to the Patrimonial Responsibility of the State, not only of the administration, we also find, as we Will see in the development of the present theme, contributions to the Legislator's Patrimonial Responsibility, by unconstitutional laws. Undoubtedly, the issue of State Asset Liability is a subject that can be considered recent, since it is scarce twelve years that this was configured in our legal system, which translates into an immature and imperfect practice. The theme is developed in four parts essentially. In the first place, it is important to analyze the nature and purpose of the separation of functions and powers, as well as what specifically concerns the activity of the legislator. The object and purpose of constitutional justice, in its origins, as well as a brief analysis of the state of the art of Mexican constitutional justice, will lead us to conclude on a necessary reflection and criticism of the consequences of a declaration of unconstitutionality of a law, in our constitutional system.
El presente proyecto incluye un análisis constitucional-administrativo, sobre la jurisprudencia y teoría de los argumentos que dan origen a la figura de Responsabilidad Patrimonial del Legislador, como consecuencia de la declaración de inconstitucionalidad de una ley. Dicho estudio es basado en una comparación en el sistema jurídico español. La importancia y razones por las cuales se toman bases de aquel sistema, vienen dadas primeramente por que la figura genérica de Responsabilidad Patrimonial del Estado en nuestro sistema jurídico mexicano, representa las aportaciones doctrinarias del administrativista Álvaro Castro Estrada, quien a su vez representa las ideas doctrinarias del administrativista y constitucionalista español Eduardo García de Enterría, ideas que representan sin duda alguna son la inspiración de las aportaciones que en aquel país se han hechos a las figuras de Responsabilidad Patrimonial del Estado, no solo de la administración, también encontramos, como se verá en el desarrollo del presente tema, aportaciones a la Responsabilidad Patrimonial del Legislador, por leyes inconstitucionales. Sin duda, el tema de la Responsabilidad Patrimonial del Estado, es un tema que puede considerarse reciente, pues son escasos doce años que ésta se configuró en nuestro sistema jurídico, lo que traduce en una inmadura e imperfecta práctica. El tema se desarrolla en cuatro partes esencialmente. En primer lugar, es importante analizar la naturaleza y fines de la separación de funciones y de poderes, así como lo concerniente específicamente a la actividad del legislador. El objeto y fines de la justicia constitucional, en sus orígenes, así como un breve análisis del estado del arte de la justicia constitucional mexicana, nos llevaran a concluir sobre una necesaria reflexión y critica a las consecuencias de declaración de inconstitucionalidad de una ley, en nuestro sistema constitucional.
