La hermenéutica jurídica en las sentencias agrarias

Abstract

The purpose of this research is the study and analysis of Article 189 of the Agrarian Law concerning agricultural judgments; such as these, as they should be given and taken into account when issuing them; observing, that they are dictated to truth known without subject to the rules on evidence estimate only offering facts and documents as deemed due in conscience; whereas such does not provide real security and legal certainty to agricultural justiciable. Based on a documentary research, with support in dogmatic questions, both to judgments, types of these as well as in the study of legal interpretation, the legal and jurisprudential aspects, which have been associated with the delivery of justica land; specifically with land sentence. Trying to bring the importance of the application of legal interpretation to dictate agricultural sentences; thereby to provide greater security and legal certainty to agricultural justiciable under that by this knowledge can reach a precise Agrarian Law clearer interpretation and thus the desired legal security when resolving any conflict of Mexican agriculture in under the implementation of the Land Law. It concluded that it should give a legal reform that provides for the application of legal interpretation in agricultural sentences; whenever the legal interpretation is a fundamental tool under this science is the art of interpreting texts to set a true sense; and thereby give the desired subject agricultural security and legal certainty incurred to achieve a true agrarian justice.

La finalidad de la presente investigación lo es el estudio y análisis del artículo 189 de la Ley Agraria referente a las sentencias agrarias; como son estas, como deben de ser dictadas y que se toma en cuenta al momento de dictarlas; observando, que las mismas se dictan a verdad sabida y sin necesidad de sujetarse a las reglas sobre estimación de pruebas solo ofreciendo los hechos y documentos según lo estimaran debido en conciencia; considerando que estas no otorga una verdadera seguridad y certeza jurídica a los justiciables agrarios. Basándonos en una investigación de tipo documental, con sustento en cuestiones dogmáticas, tanto a las sentencias, tipos de estas así como en el estudio de la hermenéutica jurídica, las normas legales y aspectos jurisprudenciales, que han tenido que ver con la impartición de la justica agraria; concretamente con la sentencia agraria. Tratando de aportar la importancia que tienen la aplicación de la hermenéutica jurídica al dictar las sentencias agrarias; ello para darle mayor seguridad y certeza jurídica a los justiciables agrarios en virtud de que mediante esta ciencia se puede llegar a una interpretación más clara precisa de la Ley Agraria y con ello la anhelada seguridad jurídica al momento de resolver cualquier conflicto del agro mexicano, en virtud de la aplicación de la Ley Agraria. Llegado a la conclusión de que se debe de dar una reforma legal que establezca la aplicación de la hermenéutica jurídica en las sentencias agrarias; toda vez que la hermenéutica jurídica es una herramienta fundamental en virtud de que esta ciencia es el arte de interpretar textos para fijar un verdadero sentido; y con ello dar la anhelada seguridad y certeza jurídica a los sujetos agrarios habidos de alcanzar una verdadera justicia agraria.
