Bandwidth and internet are telecommunication services, which, combined with the use of communication devices, create a metaphysical world, in which the exchange and interaction of information between millions of people can be generated instantly, this entity is called information and communication society, however, there is a digital gap, which limits millions of people to not being able to access this information world, because they do not have an adequate bandwidth or internet connection. Then, derived from the study of the benefits brought by the use of these services in society, several fundamental legal instruments recognize bandwidth and internet as a fundamental right, which is the responsibility of the state to ensure compliance, however, in the state of Michoacán there are people who are limited to have a bandwidth and/or internet connection, so the objective is to demonstrate whether the amparo trial is the appropriate means to request the state to guarantee the right of access to broadband and internet? In this context, the Amparo trial, being a means of constitutional control, would be the ideal judicial means to request that access to this right be guaranteed.
El ancho de banda e internet, son servicios de telecomunicaciones, los cuales, combinados con la utilización de dispositivos de comunicación, crean un mundo metafísico, en el cual se puede generar al instante el intercambio e interacción de información entre millones de personas, a este ente se le llama sociedad de la información y comunicación, sin embargo, existe una brecha digital, que limita a millones de personas a no poder acceder a este mundo informativo, por no contar con un ancho de banda adecuado o una conexión a internet. Entonces, derivado al estudio de los beneficios que trae la utilización de estos servicios en la sociedad, diversos instrumentos jurídicos fundamentales, reconocen al ancho de banda e internet como un derecho de carácter fundamental, el cual es responsabilidad del estado garantizar su cumplimiento, sin embargo, en el estado de Michoacán existen personas las cuales se encuentran limitadas de tener un ancho de banda y/o conexión a internet, por lo cual el objetivo es demostrar, ¿si el juicio de amparo es el medio idóneo para solicitar al estado que garantice el derecho de acceso a la banda ancha e internet? En este contexto, el Juicio de Amparo al ser un medio de control constitucional, sería el medio judicial idóneo, para solicitar se garantice el acceso a este derecho.
