La protección del derecho humano de propiedad inmueble en Michoacán, mediante el sistema constitutivo registral

Abstract

Human Rights are recognized and protected in national and international legal instruments in order to make effective the idea of human dignity. In Mexico, Article 1o of the Mexican Constitution expressly recognizes them. The right to property, as a Human Right, is protected mainly in article 27 of the mentioned Act. The principle of legal security, as one of the guarantees that protect it, is deposited in articles 14 and 16 of the same legal instrument. One of the main objectives of the Public Registration of Property, as an organ of public administration, is to provide legal security to the registered properties and to provide publicity so third parties get to know about all registered deeds. Michoacán’s registration system is of the declarative type; all deeds that may affect third parties’ interests shall be registered. In the constitutive system the right is born with the contract or legal act; it acquires legal perfection when it is registered; registry is mandatory. Therefore, it provides a better protection to the Human Right to land property.

Los Derechos Humanos están reconocidos y tutelados en instrumentos legales nacionales e internacionales con el fin de hacer efectiva la idea de dignidad humana. En México el artículo 1° de la Constitución Política de los Estados Unidos Mexicanos los reconoce expresamente. El derecho a la propiedad, como Derecho Humano, se tutela principalmente en el artículo 27 de la Constitución Mexicana. El principio de seguridad jurídica, como una de las garantías que lo tutelan, está depositado en los artículos 14 y 16 del mismo instrumento legal. El Registro Público de la Propiedad, como órgano de la administración pública, tiene, como principales objetivos, dar seguridad jurídica a los bienes inscritos y dar publicidad frente a terceros de todo lo anotado y registrado. El sistema registral en Michoacán es declarativo; sólo se inscribirán aquellos actos respecto de los cuales se tenga la intención de que surtan efectos frente a terceros. En el sistema constitutivo el derecho nace con el contrato o acto jurídico y para su perfeccionamiento es necesaria su inscripción, que es obligatoria. Por tanto, propende a tutelar más ampliamente el Derecho Humano a la propiedad inmobiliaria.
