Abstract

This research was chosen because of the concern that exists about the proliferation of so-called dangerous crimes; Being that in many cases an extreme advance of the criminal law is given, originating an irrational growth increasing of this one; And it is even more alarming now that their attempt is being punished, specifically in crimes against health. Reason for which SE caused great interest in observing the reason for such application, since, in addition, appear interpretations of the judicial power in which the punishment of these unrighteous is legitimated; As well as to analyze whether this interpretation is commendable and praiseworthy to the criminal law and to the doctrine; And thus determine if these are correct, or if instead there is no single meaning, ie there is a polysemy. In order to establish and visualize the legitimacy of such punishment and its legal support. For all the above, it remains to be said that the investigation is unsettling and attractive. The investigation began by observing the need to interpret legal texts in order to make sense of the norm and thus establish the content of crimes against health and its attempt, so that the subject was very feasible in this regard, and That sufficient information was available, which yielded interesting results, thus proving the hypothesis raised; Since it was determined that the crimes against health belong to the crimes of danger, also analyzing their classes, their penalties and the protected legal right. In order to determine that the attempt is currently being applied in transportation and sale, of which the criminal legal analysis was carried out

Este trabajo de investigación fue elegido por la inquietud que existe sobre la proliferación de los denominados delitos de peligro; siendo que en muchas ocasiones se da un adelantamiento extremo del derecho penal, originándose un crecimiento irracional cada vez mayor de éste; resultando todavía más alarmante que ahora se esté penando su tentativa, específicamente en los delitos contra la salud. Razón por la cual SE causó gran interés en observar la razón de dicha aplicación, ya que, además, aparecen interpretaciones del poder judicial en las que se legitima la punición de estos injustos; así como analizar si dicha interpretación es acorde y loable a la ley penal y a la doctrina; y así determinar si éstas son correctas, o si en cambio no existe un solo sentido, es decir, hay una polisemia. Para así establecer y visualizar la legitimidad de dicha punición y su sustento jurídico. Por todo lo anterior, sobra decir que la investigación resulta por demás inquietante y atractiva. La investigación se inició al observar la necesidad de interpretar los textos jurídicos, a fin de dar sentido a la norma y, así establecer el contenido de los delitos contra la salud y su tentativa, por lo que al respecto el tema fue muy factible, ya que se contó con la información suficiente, lo cual arrojó interesantes resultados, comprobándose así la hipótesis planteada; pues se determinó que efectivamente los delitos contra la salud pertenecen a los delitos de peligro, analizándose también, sus clases, sus penalidades y el bien jurídico protegido. Para así determinar que actualmente la tentativa se está aplicando en el transporte y la venta, de los cuales se realizó el análisis jurídico penal.
