The collective actions should surpass the coverage of mechanisms bounded to certain rights and be projected to a Normative Collective Guarantees, which is defined as the process of constitution and organization of positive, wide and flexible warranties, properly legislated as collective procedural rights where it is possible to require the fulfillment of every kind of group rights and interests, which implies an expansion of the constitutional justice and a systematization of warranties common to every right and country. Mexico designed a reform of collective actions through a modifying decree which established overregulated procedures in the Federal Code of Civil Procedures, restricting the collective actions to the consumption and environmental matters, omitting the guardianship to the other collective rights thereby failing the motive exposition of the constitutional reform in collective actions and the coverage of rights and warranties in the first article of the Constitution of Mexico. If rules of an eminently civilian and strict right game are established, the civil appreciation of the nature of the collective rights will be hampered and difficult. Therefore that reform is restrictive, prone to omission, complicated and unconstitutional. The collective action of appeal for protection will emerge as a specialty in the appeal for protection generated by the constitutional reforms in appeal and human rights and it will have the characteristics of a new subject matter and will also require judges and litigants with a new profile in constitutional and human rights. Their main objective will be to link the judicial decisions to the compliance of the human rights through a procedure that considers the violation of the human rights in relation to the collective rights. The new mexican constitutional order does not comply with a real Normative Collective Guarantees, since it presents warranty gaps for each and every one of the collective rights and omits compliance instruments for human rights and verdicts.
Las Acciones Colectivas deben superar la cobertura de mecanismos acotados a ciertos derechos y proyectase hacia un hacia un Garantismo Colectivo Normativo, el cual se define como el proceso de constitucionalización y organización de garantías positivas, amplias y flexibles debidamente legisladas como derechos procesales colectivos donde sea posible exigir el cumplimiento de todo tipo de derechos e intereses de grupo, lo que implica una expansión de justicia constitucional y una sistematización de garantías comunes a todos los derechos y a todos los países. México diseñó una reforma de acciones colectivas mediante un decreto modificatorio que estableció un sobre regulado procedimiento en el Código Federal de Procedimientos Civiles, restringiendo las acciones colectivas a las materias de consumo y medio ambiente; omitiendo la tutela a los demás derechos colectivos con lo que se incumple con la exposición de motivos de la reforma constitucional en acciones colectivas y con la cobertura de derechos y garantías enunciados en el artículo 1º de la Constitución de los Estados Unidos Mexicanos. Al establecer reglas del juego eminentemente civilistas y de estricto derecho, se va a dificultar en sede civil la apreciación de la naturaleza de los derechos colectivos. Por lo tanto, esta reforma es restrictiva, omisiva, complicada e inconstitucional. La Acción Colectiva de Amparo en Derechos Humanos surgirá como una especialidad de amparo indirecto generada por las reformas constitucionales en Amparo y Derechos Humanos, y por la reforma a la Ley de Amparo, además de tener características de una nueva materia, también exigirá un nuevo juez de perfil garantista y una nueva formación de litigante defensor de los Derechos Humanos. Su reto fundamental será vincular las decisiones judiciales al cumplimiento de los Derechos Humanos por medio de un quejoso colectivo que haga valer conceptos de violación a Derechos Humanos vinculados a los derechos colectivos.
